RIGHT OF WITHDRAWAL
Pursuant to art. 52 of Legislative Decree 206/05, the Consumer may withdraw from the contract, without having to provide any reasons and without penalty, within 14 (fourteen) days from receipt of the purchased products.
The Consumer who intends to exercise the right of withdrawal must send – within the aforementioned period of 14 (fourteen) days – an explicit declaration to this effect, to which they must attach a copy of the purchase invoice and the code of the purchased item. In any case, the Consumer undertakes to return the goods, without undue delay and in any case within 14 (fourteen) days from the date of communication of the withdrawal, organizing the shipment and/or the relative return methods, being aware that the costs of returning the product are at the Consumer’s expense.
Grimaldi Food S.R.L. (hereinafter Grimaldi Food) will refund the price of the returned product, using the same means of payment chosen by the Consumer at the time of purchase. In case of payment made by credit card or PayPal, the Consumer will receive the refund directly on the payment method used; on the contrary, in case of payment made by bank transfer or cash on delivery, the Consumer must provide Grimaldi Food, accessing the “Contact us” section, with the bank details (IBAN), necessary for the refund.
In case of valid exercise of the right of withdrawal, Grimaldi Food will refund to the Consumer all payments received in relation to the product for which the right of withdrawal is exercised, within 14 (fourteen) days from receipt of the communication concerning the intention to withdraw. In any case, Grimaldi Food reserves the right to withhold the refund until the moment of the return of the product by the Consumer or until the moment in which the Consumer has not provided clear proof of return of the goods in question to Grimaldi Food.
It is however understood that the essential requirement for the valid exercise of the right of withdrawal consists in the return and integrity of the goods, which must be returned to Grimaldi Food intact, in the original packaging and complete with the fiscal documentation attached to it. Failure to comply with the prescribed provisions, legitimates Grimaldi Food to refuse the right of withdrawal and the return of the purchased product.
CONSUMER RIGHTS IN TERMS OF CONFORMITY AND GUARANTEES OF PRODUCTS
Pursuant to art. 130 of the Consumer Code, in case of lack of conformity of the purchased products, the Consumer has the right to the restoration, without charge, of the conformity of the product, through repair or replacement of the goods.
Also in this case, essential requisite for the valid exercise of this right is the return of the goods in their integrity, which must be returned to Grimaldi Food intact, in the original packaging and complete with the fiscal documentation attached to it.
